Use of Student Data by Employers
Employers may only use student profile information and application materials for evaluating candidacy for open roles posted on MNTRSHIP. Any retention, repurposing, reproduction, or distribution of student data outside this scope is strictly prohibited.
Third-Party Tools and Automated Decision-Making
Employers must not rely solely on automated tools, bots, or AI decision systems to evaluate or reject applicants unless fully compliant with federal, state, and local employment law. Use of any third-party systems in conjunction with MNTRSHIP remains subject to these Terms and to the applicable laws.
Platform Role Disclaimer
MNTRSHIP operates solely as a technology provider facilitating connections between users. MNTRSHIP is not an employer, recruiting agency, or party to any employment contract, and disclaims all liability for decisions made by users through or outside of the platform.
Employer Legal Compliance
Employers agree to comply with all applicable employment laws and regulations, including but not limited to the Equal Employment Opportunity Commission (EEOC), the Fair Credit Reporting Act (FCRA), the Office of Federal Contract Compliance Programs (OFCCP), and any applicable state or local laws regarding hiring practices and recordkeeping.
Restrictions on Platform Use and Access
Users may not reproduce, resell, reverse-engineer, or interfere with MNTRSHIP’s systems or software. The use of data scraping tools, bots, or unauthorized access methods is prohibited. All access must be in accordance with these Terms and intended platform usage.
Verified vs. Unverified Student Accounts
MNTRSHIP distinguishes between Verified and Unverified student users.
A “Verified Student” is an individual who registers through a school-issued invitation and receives a “Verified” designation within the MNTRSHIP system. This status indicates the user’s account has been created under the supervision of a school that has licensed the MNTRSHIP platform.
An “Unverified Student” is any student who creates an account without a school-issued invitation link. These users do not receive the “Verified” designation and may be subject to additional verification, limitations on platform features, or usage restrictions.
Unverified users represent that they are at least 14 years old and have obtained the necessary consent from a parent, legal guardian, or school representative.
MNTRSHIP may restrict, suspend, or revoke access for any unverified users who violate these Terms or who cannot provide sufficient proof of eligibility or authorization. MNTRSHIP disclaims all responsibility for employer interactions with unverified users.
Schools that invite students through MNTRSHIP represent that they have the legal authority under FERPA or other applicable law to consent on behalf of those students. MNTRSHIP does not assume responsibility for the actions of students invited by schools acting outside their legal scope of authority.
Governing Law
These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Delaware. Class actions and jury trials are waived.

Limitation of Liability
To the maximum extent permitted by law, MNTRSHIP shall not be liable to any User, its employees (whether in their official or personal capacities), students, or any third party for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or business opportunities, arising out of or related to this Agreement or the pilot program, even if MNTRSHIP has been advised of the possibility of such damages. MNTRSHIP’s total aggregate liability for any claim arising from or related to this Agreement shall not exceed the total amount of fees actually paid by the School to MNTRSHIP under this Agreement.

The User (including Schools, Employers, and Students) agrees to indemnify, defend, and hold harmless MNTRSHIP, its affiliates, officers, directors, employees, and agents from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from (a) the School’s participation in the pilot program; (b) the acts or omissions of the School’s employees, contractors, representatives, or students, whether acting within the scope of their duties or otherwise; or (c) any breach of this Agreement by the School. This indemnification expressly applies to claims brought by the School’s employees in their individual capacities.

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to this Agreement, including its breach, termination, enforcement, interpretation, or validity, shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. The arbitration shall be conducted in Delaware before a single arbitrator, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The parties agree that (a) arbitration shall be conducted on an individual basis and not as a class, collective, or representative action, and (b) each party waives any right to a jury trial or to participate in a class action. The arbitrator shall have authority to award any remedy or relief that a court of competent jurisdiction could award, consistent with the limitations of this Agreement.
